Understanding the Use of Policy Research by Amici: The Case of Fisher

Abstract

Research acquisition, interpretation, and use in the policy arena are components of a dynamic and complex process. Studies have explored these processes across a variety of contexts, but there is a notable absence of the examination of the legal arena in the use-of-research literature. Extending theory developed through previous work, the current study asks: How do attorneys of record for amici in Fisher acquire, interpret, and use research in their briefs submitted to the U.S. Supreme Court? This study challenges the research use literature to become increasingly integrated and complex in the ways it cuts across actors and frames to allow for better understanding of, and application in, the legal context in general and with amici in particular.
