Opting Out: What Types of Students Waive Language Services and How Often Do Waivers Occur?

Sat, April 14, 12:25 to 1:55pm, New York Hilton Midtown, Floor: Second Floor, Gibson Suite

Abstract

Although the provision of English language services is legally required for students identified as English learners (ELs), parents have the right to waive such services. Little is known about waiver students, and basic questions have been left unanswered. This study aims to provide information regarding what waiver students look like and how often waivers occur. Using data from a large, urban district, we found waiver rates increased over the time period of the study (2008-09 through 2011-12). We also found students who attended schools of choice were far more likely to waive services, raising questions about the equity of schools of choice. Further work is needed to explain why parents waive services, especially when choosing a charter school.
