Unfulfilled Promises, Unfunded Mandates, an Unsustainable Situation: Federal Special Education Funding in Light of Endrew F.

Abstract

In light of the Supreme Court’s recent decision in Endrew F. v. Douglas County School District RE-1, and of statements that have been made by numerous federal officials in both the legislative and executive branches expressing agreement with that ruling, the objective of this paper is to present an analysis of the legal mandates reaffirmed by that decision, as well as of the decision’s likely financial implications, given the history of federal funding for special education.
