Research Comparing Novice Tertiary Law Students With Legal Academic Experts and Preliminary Research Findings of Pedagogical Designs to Support Novice Student Learning

Abstract

This session reports on two studies. The first study used a verbal protocol method to examine first-year tertiary legal student novices and legal academic experts in their comparison of judgments across two legal cases, responses to questions about the cases, and a problem-solving task. Also reported are the preliminary results of a second study that applied the first study and the pedagogical elements of analogical encoding and productive failure to tutorials within a hypermedia learning environment. The performance of legal student novices within the tutorials are examined. Implications of this research related to professional legal education and learning design are also discussed.
