Legal Constraints Upon Institutional Authority and the Ability to Act: Dispositions of Preservice Candidate

Abstract

This paper is designed to provide a stimulus for participants to consider, discuss, and debate a legally sufficient means to initiate a restructuring effort that would integrate examined theory into the way in which dispositions toward teacher and counselor education are measured, evaluated, and subsequently implemented into programs of preparation for educational practitioners. Participants will be provided with case summaries of several court decisions that have addressed the issue of removal of pre-service candidates from programs because of perceived dispositional concerns and will subsequently examine research based methodology for addressing what has been identified as a significant deficit in educator preparation programs.
