This paper will present a critical analysis of federal and Texas state educational policies, court cases and empirical studies to illustrate how No Child Left Behind’s (NCLB) policies and Texas’s educational accountability system impact the educational experiences of emergent bilingual students. The author will present common themes and tensions within the literature. The author argues that to create a more equitable system of assessing and monitoring emergent bilingual students, it is pertinent to analyze past and present states policies and Texas’ accountability system through the lens of critical race theory and raciolinguistic ideology to illustrate how NCLB perpetuates deficit framing of emergent bilingual students in Texas schools.
