School Employee Sexual Misconduct Standard of Care

Abstract

The standard of care for school districts to prevent and respond to sexual harassment, abuse and misconduct can be formed by reviewing a school and school district’s local policies, state laws, and federal regulations. To provide a safe school environment, a school administrator should be aware of and comply with their school’s policies and their state and federal laws and take reasonable efforts to comply with those duties. This session will review school districts responsibilities in many areas including policies, hiring, training, supervision, response to red flags and allegations, investigations, reporting and record keeping, prevention, and treatment of student victims.
