A Title IX Compliance Case Study: Downstream Gender Identity Nondiscrimination and a Federal Court Decision

Abstract

This project examines state-level compliance with a 2017 federal court decision affirming transgender bathroom access and nondiscrimination protections in three Midwestern states. Document content analysis of proposed and enacted legislation, executive action, and local school district policies across the three states suggests resistance to the implementation of policy in states that do not already align with federal regulation. Findings indicate that state-level compliance, or lack thereof, has a direct effect on whether school districts protect the rights of transgender students. As proposed changes to federal Title IX regulation have recently been announced, this project provides insight into how individual states may comply with or resist the upcoming changes, and how local-level educational actors may be impacted.
