Enactment of Federal Disability Policy to Address Disproportionality in Special Education: Temporal and Spatial Variations

Abstract

This study examines the required use of 15% of IDEA Part B funds for comprehensive coordinated early intervening services (CCEIS) due to significant disproportionality in special education between 2010-11 and 2020-21. Analyses indicate considerable variation between states and over time in the proportion of districts mandated to use CCEIS and that both LEA context and the state contribute to the likelihood that an LEA is required to use CCEIS funds to address significant disproportionality. The findings from this study provide targeted information about where CCEIS funds, as a policy mechanism, are used to address the historical exclusion of minoritized students from educational opportunities and ensure they have access to high-quality educational supports and services.
