Special Education Due Process in Nevada: Spatial and Temporal Trends and Implications for Policy

Abstract

Due process proceedings under IDEA can be a powerful tool to ensure that students with disabilities receive the educational opportunities to which they are legally entitled. However, minimal research examines how and where due process is wielded in practice. Our study investigated temporal and spatial patterns of due process proceedings in the state of Nevada, a geographically and demographically diverse state, over the past ten years. Findings indicate important contextual and temporal variation concerning where due process as a policy mechanism is used to address inadequate access to high quality educational supports and services for students with disabilities in Nevada.
