Restorative Justice and Gender: A Historical and Theoretical Inquiry

Abstract

This study examines the contemporary application of restorative justice in the U.S. from a historical and gendered perspective. It will specifically inquire into the intersection between the restorative justice movement and the women suffrage movement in the U.S. Questions to be addressed in the study include why the continued interest and attention in restorative justice while there is a decline in interest and focus on the relationship between feminism and restorative justice. How effective is restorative justice in dealing with female crime and criminality? Are women at any disadvantage with the implementation of restorative justice given their marginalized position in our society? An extensive review of restorative justice policies and practices from the perspective of gender will be undertaken. Several research methods will be employed in this study, including archival study and content analysis. Furthermore, the study will also look into how promising gender-conscious restorative practices in the U.S. is.
