A Process Evaluation of Mental Health Courts in Massachusetts

Abstract

With the increased incarceration of mentally ill offenders, the need for effective diversion programs has intensified. Following the model of other problem-solving courts, mental health courts (MHCS) have been implemented as an important innovation and alternative to routine adjudication and correction practices. While research has begun to examine how MHCS function, there is a good deal to understand about how various models approach adjudication decisions and service delivery. Drawing on interviews with service providers, decision-makers and participants within several mental health court sites, this study examines the implementation issues connected with this specialized problem-solving court within the state of Massachusetts. Specifically, this study seeks to understand the ways in which Massachusetts’ MHCS process mentally ill offenders, provide appropriate therapeutic treatments and how offenders view their experiences in the court. The results will be used to inform policy and programmatic reforms.
