Sentencing of Illegal Reentry Offenders

Abstract

Immigration offenses comprised almost 30 percent of the federal sentencing caseload in fiscal year 2015. Most of these offenders are convicted of illegally reentering the United States after a previous deportation, with the next most common offense being alien smuggling. In 2015, the United States Sentencing Commission published a study of these illegal reentry offenders and in 2016, the Commission proposed changes to the way these offenders are sentenced. This presentation will present an overview of immigration offenders in the federal system including examining some personal characteristics.
