Prosecutor Misconduct: A Phenomenological Study

Abstract

This research describes the phenomena of prosecutor misconduct through ethnographic content analysis of 190 California and Texas court cases in which claims of prosecutor misconduct were raised on appeal. The study further examines major themes arising from the content analysis with in-depth case studies from five Texas appellate cases from the sample, as well as interviews with 10 current and former prosecutors. Unlike previous research conducted by interest groups who have a vested stake in outcomes, this study was done by an objective reviewer using social science methodology.
