Survivors’ perceptions of sexual assault case processing in the criminal justice system: Reflections on receiving the medical forensic exam and how the evidence matters

Abstract

Past research has examined how particular characteristics of sexual assault cases relate to case outcomes such as likelihood of suspect arrest. But, less is known about how specific evidence gathered during the sexual assault medical forensic exam relates to how cases proceed through the criminal justice system. The Urban Institute is examining such exams and other case characteristics in achieving investigative and prosecutorial outcomes in sexual assault cases in two counties in one northeastern state. In addition to conducting comprehensive case reviews to identify which evidence and case characteristics predict outcomes, we conducted focus groups with survivors to learn more about their experiences with sexual assault case processing. Drawing on our findings from these conversations, this presentation will discuss survivors’ perceptions on their experiences with the criminal justice system. Specifically, we will explore their reflections on the medical forensic exam, how evidence gathered during the exam contributed to (or did not contribute to) their case, and their interactions with the various first responders involved in their case.
