Indigent Defense Systems and Access to Justice: A Comparative Analysis

Abstract

The legitimacy of the courts is built upon a foundation of guaranteed constitutional rights. Despite the Sixth Amendment’s guarantee of legal counsel for criminal defendants, many states struggle to provide quality legal counsel for all those who need it. The results of underfunded and overburdened indigent defense systems are far reaching, as individuals are denied quality legal representation and the damage in guilty pleas, prison time, and financial costs drains lives and resources. The present study reviews the current indigent defense systems across the United States and several emerging democracies. A comparison is made across the disparities in organization, funding, and outcomes. The challenges in strategically planning for indigent defense systems are addressed. Lastly, implications for policy are discussed.
