Roundtable: Examining the Place of Gender Within Hate Crime Law: An International Discussion

Abstract

This roundtable session considers the place of gender in hate crime legislation. Through an international lens, including perspectives from the United Kingdom, the United States, and Australia, the session will examine the global picture for gender and hate crime, assessing the obstacles for including and/or using the gender category within hate crime law. While many jurisdictions have enacted hate crime statutes with a list of protected groups, the category of gender remains either overlooked or underused in terms of law enforcement. We will examine the reasons for this and assess the status of gender in hate crime policy, and what purpose it might achieve in terms of being responsive or preventative. Furthermore, the session aims to critically assess whether including gender as an enumerated category is beneficial to gender-violence victims, and what additional funding or policing implications there might be for these types of crimes. Finally, the session will address broader questions around the conceptualisation of gender. We will ask how gendered hate crime can be addressed in a patriarchal society, and whether gender can be added without altering the current hate crime framework. The discussion will also assess pertinent intersectional issues.
