Roundtable: Does an Adversarial Judicial System Encourage Police Misrepresentation of Fact Patterns

Abstract

The current round-table attempts to address the idea of whether an adversarial criminal justice system creates a judicial environment in which police officers are encouraged (if only informally) to misrepresent fact patterns associated with day to day encounters and arrests. This is particularly important in lieu of whether the intent of law, with respect to seeking justice, is lost within the competition of the street and the courtroom.
