From “3 Strikes & You’re Out” to Too Many Strikes to Count: Women, Crime, and Justice under the New Regime

Abstract

The panoply of 1990s get tough on crime policies that dramatically increased incarceration contained hidden consequences for women, even as some were sold as benefitting women. Fear of crime rhetoric is once again being deployed to promote policies that are unlikely to be gender-, race-, or class-blind or neutral. With a feminist theoretical framework, this paper explores the past and future consequences to women and considers: What will women pay for this new law and order pitch?
