Examination of Juvenile Waivers Pre and Post Miller

Abstract

This paper will examine the extent to which courts have honored the Supreme Courts verbiage that juveniles are different and should be treated differently by the justice system. The paper will examine cases in Alabama that were waived to criminal court before the Miller decision and after the Miller decision to determine whether changes have occurred in the types of sentences given to juveniles after the Supreme Court decision. Results will address systemic and philosophical concerns of Supreme Court rulings versus court practices related to the transfer and treatment of juvenile offenders.
