Can We Kick It? An Analysis of the Decision to Prosecute Corporate Criminal Cases in the U.S.

Abstract

Using compiled data on over 300 public corporations charged with criminal offenses in the U.S., the current study applies both multivariate regression models and conjunctive analysis of case configurations to assess the causal influence of both legal and extralegal factors on the likelihood of deferred (or declined) prosecution. The assessment will also account for the possibility of causal asymmetry based on whether or not the company was charged with financial fraud (e.g., securities fraud).
