Jury Reform in America: An Examination of the Benefits and Downsides of Professional Juries for Felony Cases

Abstract

In making decisions dealing with the liberty and even lives of fellow citizens, juries face an awesome responsibility. The American model, “a jury of our peers”, has been in place since the country’s founding. However, few question whether or not this system is the most appropriate. The purpose of this study was to research the various jury systems used around the globe, including the use of professional juries, and determine which is most effective. The main types of jury systems were analyzed, particularly from the scholarship of Hans and Marder, so as to fully understand the complexities of juries. Data were acquired from the BJS, FBI and the National Registry of Exonerations to decide what role wrongful convictions plays in the analysis. Ultimately, it is concluded that the positives of professional juries for felony cases outweigh the negatives.
