Capital Punishment and Its Diversion in Chinese and Global Perspective

Abstract

Criminal justice systems that employ capital punishment provide a variety of points throughout the death penalty process at which the ultimate sanction may be avoided. The first two papers in this panel examine capital punishment in China, the world’s most prolific executioner. Michelle Miao considers the role of Chinese capital defenders in adjudication proceedings. Tobias Smith analyzes China’s central death sentence review system, the final procedural opportunity for an individual to avoid execution in China. In the third paper Andrew Novak places China in global perspective by considering another route to death’s diversion around the world—clemency.
