Using a critical feminist lens, this paper examines the repeal of Roe v. Wade and subsequent legal initiatives to criminalize abortion in the United States. Currently, thirteen states have passed abortion ban legislation, or “trigger laws”, that will be activated once the Supreme Court overturns the law. With the fall of Roe imminent, state legislators continue to draft legislation which would criminalize the procedure. Consequences of having an abortion would include criminal charges, sentences and fines for abortion patients and providers. Like many other crimes, this legislation would disproportionately impact the most vulnerable in society, specifically women and mothers in poverty. By applying critical feminist theory, this papers seeks to gain a better understanding of state criminalization of abortion and examines the role of critical criminology in discussions around reproductive rights.
