Shaping Public Defense in Idaho: Exploring Attitudes and Practices for Statewide Vertical Representation Implementation

Abstract

The Idaho public defense system is implementing a statewide practice shift in 2024 to ensure consistent adoption of vertical representation (one client, one attorney), throughout all counties. Ahead of implementation, the Idaho Public Defense Commission (PDC) requested the JFA team to support this practice change through TTA focused on understanding issues around vertical representation and identifying strategies to address potential barriers or concerns. RTI, in partnership with NACDL and PDC, fielded a survey to all public defense attorneys in the state (public defenders and private assigned counsel) and conducted a series of interviews with public defense attorneys, prosecutors, and judges. The goal of this study was to understand current operations and attitudes towards styles of practice, knowledge of vertical representation, and potential barriers and resources needed for consistent implementation. This session will present findings and recommendations.
