The number of individuals reappearing in court to be considered for resentencing continues to grow in California as Penal Code 1172 and AB 600 reforms materialize. Each of these individuals represents a unique pathway into the criminal justice system and, consequently, to resentencing proceedings. Despite the differences in individual cases, legal processes require uniformity to attempt equitable application of the law. Given the recency of these reforms, the knowledge surrounding the formal process of resentencing and its interplay with the dynamics of individual cases is lacking. To begin creating this knowledge base, this study takes a case study approach in order to understand the process and experience of moving through resentencing in San Diego County from a micro-level perspective.
