Italian-Style Whistleblowing: The Difficult Integration of a Model of Prevention and Detection of Crimes

Abstract

Since 2012, with the Severino law against corruption, whistleblowing has been a part of the Italian legal system. Since then, there have been numerous changes, including a reform in 2017 and the transposition of the 2019 European directive, last year, with Legislative Decree No. 24 of 2023. The purpose of this study is to explore the analyses of Transparency International Italy and other bodies in the sector, which have found this instrument to be ineffective and unreliable. Through a comparative examination of the perception of corruption and the faith of citizens, as well as a careful analysis on the actual methods of operation of control systems, the present study seeks to formulate hypotheses on the non-implementation of control systems in countries of continental law. The study will start from statistical data to analyze the impact that the reward system has on whistleblowers in the United States to better understand cultural and systemic differences. The study will show the inadequacy of the current European approach, which has not taken into account cultural differences and has not adapted the governance systems already in place with information flows.
