The fight for abortion rights in the United States of America has been an ongoing battle since 1973, after the United States Supreme Court established the constitutional right to access abortion in the case Roe v. Wade (1973). Fifty years later and the original precedent set in Roe v. Wade (1973), which had been affirmed in Planned Parenthood of Southeastern Pennsylvania v. Casey (1992), was overturned in the case of Dobbs v. Jackson Women’s Health Organization (2022). Since then, the main question raised and the one examined in the present research is, how have women’s rights to abortion access changed after the ruling of Dobbs v. Jackson Women’s Health Organization (2022)? Using a review of recently passed and proposed legislation, as well as landmark United States Supreme Court cases, the present research found that women’s rights to abortion access have changed drastically since the overturning of Roe v. Wade (1973) and Planned Parenthood of Southeastern Pennsylvania v. Casey (1992). Understanding how legal rights to abortion access have changed provides insight into an ever-changing legal landscape and suggests that further changes are likely to come, either to expand access or to further limit access.
