Discrimination based on disability/hearing status and discrimination based on criminal history are two prominent complaints filed with the United States Equal Employment Opportunity Commission (EEOC). These issues run parallel to each other in that they (a) are difficult to prove and adjudicate, (b) keep qualified individuals out of the workforce, and (c) increase likelihood of recidivism or dependence on social welfare programs. Deaf individuals who have criminal histories face a double-disadvantage in securing employment. This presentation will provide a brief comparison of legislation around both types of employment discrimination and provide guidance for advocacy and rehabilitation.
