Abstract

The evolution of artificial intelligence (AI) is ushering in a revolutionary period that compels a reassessment of the pillars of the criminal legal system and the very definition of human dignity. With the emergence of Homo Technicus, individuals are increasingly integrated with technology from birth. Growing up in a world where AI and automation permeate every single aspect of life. Such a challenge necessitates a fundamental reassessment of legal principles to safeguard human rights and maintain social cohesion, with a particular focus on protecting the foundations of the legal order, especially within the sphere of criminal justice. This study highlights the imperative call for action from the legal system to adapt, ensuring a framework that guarantees peaceful coexistence between humans and machines while developing ethical and legal principles that address the unique challenges posed by this integration. Historical precedents and classical legal doctrines, including the development of legal realism, indicate the proper way to contextualize the ongoing paradigm shift. The final discussion emphasizes the necessity of redefining the concept of human dignity in a world where technology is an intrinsic part of human existence.
