The deportation of delinquent youth is an evolving issue intersecting the juvenile justice system, the enforcement of laws, particularly immigration law vis-a-vis legal challenges, national security, humanitarian, and ethical concerns. This paper will discuss these challenges in light of the disproportional impact these have on minority youth and families, due process, the definition of delinquency (state law vs. immigration law), and rehabilitation and punishment in a system funded under the principle of the best interest of the child.
