Algorithmic Injustice: The Implication of Technological Advancements on Democratic Ideal in the Criminal Justice System

Abstract

As technological tools such as predictive policing algorithms, facial recognition software, and risk assessment systems become increasingly integrated into criminal justice practices, concerns have emerged regarding their impact on the democratic ideal of fairness, equality, justice and liberty under the law. This paper critically examines how the collection and use of biased data in these technology applications disproportionately affect minority communities, perpetuating systemic inequalities and undermining trust in legal institutions. Using a qualitative methodology based on secondary sources such as academic literature, case studies, investigative reports, and policy analyses, this research explores the intersection of technology, criminology, laws, and the democratic ideal. The findings illuminate the ways in which algorithmic bias replicates historical injustices, contributing to over-policing and discriminatory outcomes. The paper concludes by discussing policy and oversight measures needed to align technological advancements with democratic ideals and to ensure accountability, transparency, and equity in their implementation.
