This paper deals with the importance of legal mechanism available to deal with the crime of genocide by addressing the responsibility of the state of Serbia for the crimes committed in Kosovo. Can Kosovo as a de facto state get access to the ICJ jurisdiction and file a genocide lawsuit against Serbia for the crimes committed on the territory of Kosovo in the 1990s? And why is it worth trying at all?
