Post-penal isolation in Poland in the context of human rights standards. Cases against Poland before the European Court of Human Rights.

Abstract

Post-penal measures has been operating in Poland for over 10 years. They were introduced into Polish legal order on the basis of the Act of November 22, 2013 on dealing with people with mental disorders posing a threat to life, health or sexual freedom of other people. The act provides for two types of post-penal measures. Isolation takes place in National Center for the Prevention of Dissocial Behavior (KOZZD). Second measure, restricting freedom without placing in the center - preventive supervision, is implemented by the Police.
Both forms, both in terms of legislation and the practice of their application, leave a lot to be desired. The best proof of this are complaints against Poland awaiting to be adjudicated in the European Court of Human Rights in Strasburg. To date, 11 of them have been communicated to Poland. The report will present the basic allegations made in these complaints in the context of human rights protection standards.
