New approach to an old problem on Polish-Belarusian border

Abstract

The significant migration crisis that affected Poland in 2021 and 2022 led to many changes in the law, both positive and negative. In February 2024, the Sejm of the Republic of Poland adopted a law that allows for the temporary and territorial suspension of the right to apply for international protection. The law is likely to be approved by the Senate and the President of the Republic of Poland, becoming binding legislation. It is worth examining the consequences this law may bring, both on a national and international level.
During this presentation, I will primarily outline the provisions of the new law, critically analyze it from the perspective of national and international regulations, and highlight how such regulations might influence the scope and level of crime in border regions. It will also be important to analyze the legal situation of individuals fleeing their countries of origin and seeking protection within the European Union, in light of current obligations.
It should be emphasized that the purpose of law-making should be to improve the quality of life of individuals, as well as to protect the most vulnerable individuals and groups who are particularly at risk of harm. The issue of border protection will be analyzed from the perspective of safeguarding the lives and health of migrants. The issue of human trafficking, people smuggling, and the use of violence by border guards and the military will be addressed as potential risks arising from the temporary suspension of the right to apply for international protection.
