Selected Findings from Research on Sexual Crimes in the Czech Republic

Abstract

This contribution deals with sexual crimes in the Czech Republic, because the Czech Republic, as a member of the European Union, must also reflect the changes that oblige member states, which is increased protection of women and children not only in the sexual area. In the area of criminal law, it is still true that member states retain a certain degree of sovereignty and can resolve the definition of crimes independently, but taking into account their obligations. The same is true in the case of sexual crimes, which are currently undergoing many changes, both in individual member states and in the framework of the adoption of European Union documents. Currently, the Czech Republic is undergoing an amendment of crimes related to rape, which we are studying as part of our research, not only from the perspective of the current legal regulation, but also related issues and areas, especially by comparing the status before 31.12. 2024 and after 1.1. 2025. In particular, with individual actions that may or may not be classified as these crimes, as well as statistical data and application practice, especially decisions of the Supreme Court and the Constitutional Court of the Czech Republic. The authors will present the results of the research and their conclusions on whether the change in the legal regulation was implemented appropriately.
