The devastating effects of climate change are linked to the perpetuation of situations of inequality and poverty. This provides a more than interesting opportunity for the commission of criminal conduct that generates enormous economic income. The need to deal with the climate emergency therefore places states in a situation that requires the assumption of specific commitments to deal with the degradation of the planet in the criminological, victimological and legal-criminal spheres, without forgetting the social problems that this implies.
In order to achieve a multi-focal and multidisciplinary analysis of the problem, the aim is to integrate a study of Spanish court sentences relating to criminal behaviour linked to climate crime. The aim of this part of the study is to detect areas for improvement in criminal legislation, starting with the study of the real response that the courts give to behaviours linked to climate crime, the possible difficulties of the courts, and the patterns or gaps detected in these sentences.
