The General Acceptability of Diagnoses Used in Sex Offender Civil Commitment Cases

Abstract

For sex offenders facing civil commitment, the use of diagnoses in the courtroom serves a much different purpose than for those in treatment. The Diagnostic and Statistical Manual of Mental Disorders, 5th Edition specifically warns of the risks and limitations of its use in forensic settings. Diagnoses used in the courtroom must be generally accepted in the scientific community, especially in light of the severe deprivation of liberty that is at stake.
