Insolvency and bankruptcy in the study of the Białystok School of Criminology

Abstract

Insolvency and bankruptcy alike are convenient means of debt discharge which may be particularly detrimental to creditors. Dishonesty of creditors is one of the major pathologies of a state's economy. Therefore, the criminalization of such actions requires a deeper analysis. The presentation is based on the methodology and applied scientific research. The analysis was undertaken the focuses on the structure of the act criminalized in art. 301 of the Polish Penal Code. It is also an analysis of the etiology of the analyzed crime, and at investigating the phenomenology associated to the crime. The presentation is devoted to the institutional framework of economic crime prevention. Finally the research applies an empirical study mainly directed on the practicalities of the phenomenon.
