The emphasis on the “rule of law” of introduced into the discussions of the “third wave” of democracy in Latin America have led to interest in the study of the judiciary from an institutional (rather than a formal-legalistic) perspective. This panel takes a variety of institutional approaches to the study of the judiciary in Latin America, broadly united in efforts to look at the formal and informal institutions that operate within the judiciary and bind it to the other democratic institutions.
