Challenges and Opportunities of Reserved Seats for Indigenous Peoples in National Legislatures – A Comparative Study Between Mexico and Taiwan

Abstract

This article offers a comparative analysis, using a legal sociology approach, of the mechanisms of reserved seats for the political representation of indigenous peoples in Mexico and the Republic of China (Taiwan). It examines the legal framework, sociodemographic context, historical progress, and the eligibility requirements and electoral design applied in both countries. By comparing these aspects, the study highlights the similarities and differences underlying affirmative policies that aim to include populations with a shared history of marginalization but with markedly distinct cultural, historical, and contextual realities. The article also discusses future challenges in transforming formal representation into substantive legislative impact.
